The Ministry of MSME has started a program that enables a supplier, commonly known as the MSE unit, to submit an online complaint to the appropriate MSEFC in their state or UT over a purchaser of goods or services. If the complaint is valid, the MSEFC Council will investigate the situation and make the rules and regulations available for proactive action by the respective Departments, CPSEs, Central Ministries, State Governments, and others to move on with the penalties of interest. MSMEs can report cases involving delayed payments by Central Ministries, Departments, CPSEs, and State Governments through MSME Samadhaan.

It intends to give micro and small business owners across the nation the ability to file their delayed payment issues about all State governments and their Public Sector Undertakings, as well as the Ministries and Departments under the Union Government and Central Public Sector Enterprises.

Provisions That the State Government Will Establish

The Act of 2006, Micro, Small, and Medium Enterprise Development, contains a provision that addresses delayed payments to micro and small businesses (MSMED). Chapters 15 to 24 of this act are where this provision is found. Every state government must create the Micro and Small Enterprise Facilitation Council (MSEFC) to solve challenges with obtaining references and recording delayed payments. Those chapters of the MSMED act’s Chapters 20 and 21 also make a clear reference to this information.

  • The portal allows business owners and MSEs to submit online requests for delayed payments.
  • The user must possess a Udyog Aadhaar Number that has been verified using a physical Aadhaar card to apply.
  • MSMEs and business owners can check the status of their online applications for delayed payments via the platform.
  • The Portal will include details on payments that are still pending between MSEs and particular CPSEs, Central Ministries, State Governments, etc.
  • PSE, The data on the portal will be open to the whole public.
  • CEOs and Secretaries of the relevant Ministry will be in charge of monitoring instances of delayed payments falling under their purview and issuing the required directives to address the problems associated with it.

Delayed Payments to MSME

The buyer must make the payment on or before the date that was agreed upon between the buyer and the micro or small firm if it supplies any goods or services and has MSME registration. The buyer must make payment within fifteen days of accepting the products or services if the agreement does not include a payment due date. A payment owing to a micro or small business cannot, in any case, take longer than 45 days from the day it was accepted or deemed accepted.

Penalties for Late Payment to MSME Businesses

The buyer is required to pay compound interest with monthly interest rests to the supplier on that amount starting from the date of payment or fifteen days after accepting goods or services if the buyer fails to make the payment on time. The Reserve Bank of India has announced that the penal interest payable for late payments to an MSME business is three times the bank rate. Because the Income Tax Act does not permit a deduction for penal interest paid by the buyer or payable by the buyer, the burden is made much greater.

  • The sum of the buyer’s interest payments and the value of any late payments made by the buyer

The list of documents needed to submit a request for delayed payment is as follows:

  • PDF files of the respondent’s work orders and the invoices produced in response to those orders
  • An affidavit stating that the purchase order was given orally must be supplied
  • Note that the document’s size cannot exceed 1 MB

To submit an Application on the MSME Samadhan Portal, the user needs to follow the below-given steps:

  • First of all, go to the official website of MSME Samadhan i.e., https://samadhaan.msme.gov.in/
  • The homepage of the website will open on the screen

  • A new page will open on the screen
  • Now, select the type of MSME registration i.e.,
    • Udyog Aadhaar Number
    • Udyam Registration Number
  • After selecting one of the options, enter the required details like Udyog Aadhaar/Udyam Registration Number, and your mobile number
  • Enter the captcha code and click on the Validate button
  • An OTP will be sent to your registered mobile number or email id
  • Enter the received OTP for verification
  • After successful verification, upload all the required documents
  • Finally, click on the submit button to complete the application process

To check the case status on the MSME Samadhaan portal, the user needs to follow the below-given steps:

  • First of all, go to the official website of MSME Samadhan i.e., https://samadhaan.msme.gov.in/
  • The homepage of the website will open on the screen
  • Click on the Check Case Status button
  • A new page will open on the screen
